Brothh is a directory platform. We do not sell, deliver, or guarantee any product. All transactions occur directly between buyers and producers.
By accessing or using Brothh ("the Service"), operated by Otesse ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all visitors, registered users, buyers, and producers.
Brothh is an online directory that helps people discover independent producers — farmers, ranchers, bakers, brewers, crafters, artisans, and similar small-scale makers — in their area. Brothh enables buyers and producers to find each other and communicate directly.
Brothh is not a marketplace. We do not process payments, hold funds in escrow, ship products, handle returns, or act as a party to any transaction between a buyer and a producer. Any order, contract, or exchange of goods or money happens directly between the two users and is governed by the terms they agree to between themselves.
To list products or contact a producer, you may need to create an account. You agree to provide accurate, complete, and current information about yourself, and to keep it up to date. You are responsible for safeguarding your password and for all activity that occurs under your account.
Brothh supports two primary account roles:
You must be at least 13 years old to create an account. Producers must be of legal age to operate a business in their jurisdiction.
If you use Brothh as a producer, you are solely responsible for:
Brothh does not verify, inspect, or endorse any producer listing, certification, or product claim unless expressly stated through a formal verification program.
Buyers agree to interact with producers respectfully and in good faith. You may not use the Service to harass producers, make fraudulent inquiries, or misrepresent your identity. You are solely responsible for evaluating any producer before purchasing and for any arrangement you enter into with them.
Producers retain ownership of all content they upload to Brothh, including photos, product descriptions, and stories. By uploading content, you grant Brothh a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content for the purposes of operating and promoting the Service.
You represent that you own or have the necessary rights to all content you upload, and that it does not infringe on the rights of any third party.

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied. Brothh makes no warranty regarding the quality, safety, legality, or accuracy of any producer, listing, product, or claim found on the Service. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
Any reliance on information or contact with a producer through the Service is at your own risk.
Because Brothh is a directory and not a party to any transaction, Brothh is not liable for any harm, damages, losses, injuries, or claims arising from or related to:
To the maximum extent permitted by law, Brothh's total aggregate liability for any claim related to the Service will not exceed one hundred U.S. dollars ($100) or the amount you have paid to Brothh in the preceding twelve months, whichever is greater.
You agree to indemnify, defend, and hold harmless Brothh, Otesse, and their officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorney's fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or the rights of a third party.
We may update these Terms from time to time. If we make material changes, we will notify users by email or through a notice in the Service at least seven days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of [your state], without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in [your state], and you consent to the personal jurisdiction of those courts.
